1. Agreement to these terms

These Terms and Conditions (“Terms”) are an agreement between you and Hawaii Market Expo (“HME,” “we,” “us”). They apply when you use www.hawaiimarketexpo.com (the “Site”), register as a buyer, or attend one of our trade shows at the Blaisdell Exhibition Hall in Honolulu, Hawaii. By doing any of these, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site or attend our shows.

2. Trade-only shows and admission

  • Our shows are business-to-business (B2B) and not open to the general public. Only buyers who present proper business identification are admitted.
  • Every attendee must bring a government-issued photo ID and a Hawaii General Excise (GE) license. Business cards, business checks, or business credit cards may also be accepted as proof of business status. We may refuse entry to anyone who cannot show proof of trade status.
  • Guests of buyers must buy a ticket at the box office. Guests of exhibitors must have an exhibitor guest badge and photo ID.
  • Children under 16 are not admitted. Strollers are not allowed. Pets are not allowed, except service animals.
  • We may refuse admission to, or remove, anyone at our discretion, including for violating these Terms or show rules. Refused or removed attendees are not entitled to a refund of any ticket or fee.

3. Buyer registration and badges

  • You agree to give accurate, current, and complete information when you register, including your actual GE license number, and to update it if it changes.
  • Badges are personal and non-transferable. They must be worn and visible at all times inside the show.
  • We may cancel or refuse a registration or badge that has false, incomplete, or duplicate information, or that is used by someone other than the registered person.
  • Registering does not guarantee admission; you must still meet the admission requirements at check-in.

4. Show rules and conduct

While at a show, you agree to:

  • Follow the instructions of HME staff and show security, and the rules of the Blaisdell Exhibition Hall.
  • Not smoke anywhere inside the venue.
  • Not photograph or record exhibitors’ booths or merchandise, or enter a booth, without the exhibitor’s permission.
  • Not solicit, hand out materials, or sell anything at the show unless you are an exhibitor doing so inside your assigned booth.
  • Not harass, threaten, or endanger anyone, damage property, or act unlawfully.

You are responsible for your own belongings at the show.

5. Photos and recordings

HME and its official photographers and videographers may photograph and record our shows. By attending, you agree that we may use photos and video in which you, your booth, or your products appear to promote HME, including on this Site, social media, emails, and advertising, without payment to you. If you prefer not to be featured, tell the photographer at the show or email us and we will make reasonable efforts to avoid using images of you.

6. Exhibitors

Exhibiting at an HME show is governed by the Exhibitor Application and Contract for that show, including its Show Terms and Regulations, which are available on our Exhibitors page. If anything in these Terms conflicts with the Exhibitor Contract, the Exhibitor Contract controls for exhibitors. Among other things, the Exhibitor Contract covers:

  • Deposits and payment deadlines. Deposits are non-refundable and non-transferable after booth assignment.
  • Refunds, which are available only on written cancellation received by the deadline stated in the contract, less the deposit.
  • Booth assignment by seniority, prior occupancy, and date received, and the prohibition on subletting or sharing space.
  • Exhibitor responsibility for staffing, security, insurance, and conduct of booth workers and guests.
  • Compliance with Hawaii General Excise tax and licensing, receipts for all sales, and HME’s program against underkarating and other deceptive trade practices.

Booth equipment, electrical, shipping, and other services ordered from our show decorator, I.C.S., or other show subcontractors are agreements between the exhibitor and that company.

7. Purchases at the show

Sales at our shows are made directly between buyers and exhibitors. HME is not a party to those transactions and does not sell, inspect, or guarantee exhibitors’ merchandise, pricing, delivery, returns, or warranties. Exhibitors must give receipts listing the price paid and a full description of the items sold. Any dispute about a purchase is between the buyer and the exhibitor, although we welcome reports of problems so we can enforce our exhibitor rules.

8. Changes and cancellations

Show dates, hours, location, floor plan, and list of exhibitors may change. If a show is canceled or interrupted for reasons outside our reasonable control, such as natural disasters, severe weather, public health orders, government action, strikes, utility failures, or venue closures, HME is not liable for any resulting losses, including travel costs or lost profits. Exhibitor refunds in those cases are handled under the Exhibitor Contract.

9. Using this website

  • Ownership. The Site and its content, including text, logos, photos, and design, belong to HME or its licensors and are protected by copyright and trademark law. You may view and print pages for your own business use in connection with our shows.
  • You agree not to: copy or republish Site content for commercial purposes without permission; scrape or harvest data, including exhibitor or buyer contact details, for spam or resale; try to gain unauthorized access to the Site or its systems; upload malware; or interfere with the Site’s operation.
  • Listings and third-party content. Exhibitor listings, the floor plan, and social media content are provided by exhibitors and third parties. We don’t guarantee they are accurate or complete. Links to other websites are for convenience; we are not responsible for their content or practices.
  • Messages and submissions. If you send us comments, ideas, or feedback, we may use them without obligation to you.

10. Disclaimers

The Site and our shows are provided “as is” and “as available.” To the fullest extent allowed by law, HME disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t promise that the Site will be uninterrupted or error-free, or that any number or type of exhibitors or buyers will attend a show.

You attend our shows at your own risk. To the fullest extent allowed by law, HME is not responsible for loss, theft, or damage to personal property at the show.

11. Limitation of liability

To the fullest extent allowed by law, HME and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from or related to the Site, these Terms, or our shows. Our total liability for any claim related to the Site or attending a show as a buyer will not exceed the amount you paid HME, if any, for that show. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for gross negligence or willful misconduct.

12. Indemnity

You agree to defend, indemnify, and hold harmless HME and its owners, officers, employees, and agents from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your conduct at our shows.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms, the Site, or our shows will be brought exclusively in the state or federal courts located in San Mateo County, California, and you and HME consent to their jurisdiction. Before filing a claim, you agree to contact us at info@hawaiimarketexpo.com and try in good faith to resolve the dispute informally for at least 30 days. Nothing in this section takes away any rights you have under the consumer protection laws of California, Hawaii, or your home state that cannot be waived by contract.

14. General terms

  • Changes. We may update these Terms. The updated version will be posted here with a new effective date and applies from then on.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver. If we don’t enforce a term right away, we can still enforce it later.
  • Entire agreement. These Terms, the Privacy Policy, and, for exhibitors, the Exhibitor Contract are the entire agreement between you and HME about their subject.
  • Assignment. You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition, or sale of assets.
